Pare che quella storia di tribunali e 3 sia una mezza bufala, visto che non c’è stata sentenza e comunque anche se ci fosse stata la cosa non fa giurisprudenza. Vodafone ha avuto buon gioco a pubblicizzare questa “sentenza”, come se significasse davvero qualcosa.
Sul dibattito io la vedo così.
Non me l’ha ordinato il dottore di comprare un cellulare, né tantomeno di comprarlo da 3. Se posso comprarlo a un prezzo super scontato, ma in cambio devo accettare il lock, sta a me la scelta. Se poi lo sblocco, dopo avere usufruito dello sconto, baro, sono disonesto.
Mi sembra più grave che scaricare musica pirata, perché in questo caso è una via di uscita contro un cartello che tiene i prezzi dei cd assurdamente alti. A 3 e ai suoi lock ci sono invece molte alternative e la stessa 3 vende ora cellulari senza blocco.
In Italia abbiamo avuto i soli operatori europei in grado di guadagnare anche sulla vendita dei cellulari, mentre all’estero li danno da tempo a prezzi di costo o sovvenzionati.
Ho dedidato un po’ di tempo a capire come funziona la sim lock all’estero. Sul sito di O2 si dice che si può richiede lo sblocco dopo un certo numero di mesi e/o a un prezzo. Ma manca assolutamente questa informazione sul sito. Su forum e newsgroup vari ho letto che la gente ha ottenuto lo sblocco gratis doop 12 mesi o al prezzo di 15 sterline. Certo, sono condizioni migliori rispetto a quelle applicate da 3, ma in realtà sono situazioni con comparabili. Per esempio, su O2 posso avere gratis tanti cellulari, nel senso che li ricevo senza pagare niente subito. Poi però c’è un canone a partire da 19 sterline al mese. Il quale però include anche alcune cose: 75 minuti di chiamate, 300 sms. E’ una strategia diversa da quella di 3.
Ora qualcuno penserà che è possibile avere gratis un cellulare da o2 e poi pagare subito 15 sterline per avere lo sblocco…beh, sarebbe bello, ma credo non funzioni così. Forse comunque se hai ricevuto gratis il cellulare aspettano che faccia almeno qualche mese di canone… Sul sito, purtroppo, non si spiega niente. Il che mi conferma l’idea che all’estero non sempre sono più chiari di noi italiani quando si tratta di venire incontro alla curiosità legittima dell’utente:)
Infine, una cosa che non tutti sanno: 3 e gli altir operatori europei si tutelano in vario modo contro gli sblocchi. Se vedono che la sim associata al telefono non è utilizzata pe un certo periodo, bloccano l’imei del cellulare. Che questo avvenga con 3 mi è stato detto da una persona (un collega) a cui è successo. Nel contratto di o2 invece è detto in modo più o meno chiaro (cioè, è loro diritto disconnettere il cellulare se vedono che la sim non è utilizzata).
Nota bene: nel precedente post Cavazzini difende 3, da buon addetto stampa, però a onor del vero lui l’ha sempre pensata in questo modo 🙂

Scusate l’aria da professorino, ma in Italia neppure una sentenza della Cassazione deve essere obbligatoriamente seguita da un giudice. Sentenza del giudice monocratico di Sanremo o sentenza di Cassazione, si tratta sempre dell’interpretazione della legge da parte di un magistrato, che può essere cambiata da chi viene dopo.
Soltanto un dettaglio, ora continuo a leggere te e i tuoi commentatori sulle cose veramente importanti, ossia il contenuto dei tuoi post.
Scusa professori’, ma dove la mettiamo la “funzione nomofilattica” della Corte di Cassazione? E’ in virtu’ di questa che i giudici dei gradi inferiori ne seguono regolarmente le sentenze, soprattutto quelle pronunciate dalle sezioni unite.

Detto questo, quando attivi una sim firmi tre volte il modulo, dire “non sapevo ci fosse il lock” mi pare pochino… come dice Ferd, se sblocchi sei disonesto, punto.
Braghò tra l’altro ha detto che è illecito contrattuale e che vuole l’archiviazione del penale solo perchè non c’è dolo. Significa che chi consapevolmente smanetta e rimuove il lock, lo fa con dolo (vedi negozianti di noto concorrente…). E si ricade nel penale.
Comunque la vis polemica dovrebbe essere ditottata altrove, imvho: Alex ha colto il segno, quando guarda all’estero e non cvede poi tutta questa trasparenza. Oggi c’è un articolo (mi pare sul Sole24h) che coglie un punto importante: sarà interessante vedere come i nostri incumbent si comporteranno sui mercati esteri, dove sono newcomer. Parliamone 🙂

Io avevo scritto che “neppure una sentenza della Cassazione deve essere obbligatoriamente seguita da un giudice”. Non che non deve essere seguita, bensì che non deve essere “obbligatoriamente” seguita.
